From the moment the consumer accesses the website www.cantinedellasta.com, he agrees to comply with the terms and conditions indicated below, including all the documents shown. Users are invited to carefully examine this document before using the services.

Art. 1 – Object of this contract

The object of this contract is the sale of beer, food products, as well as accessories in the quantity and quality chosen by the consumer by selecting the products on the website www.cantinedellasta.com. The goods and services for sale are those described on the pages of www.cantinedellasta.com. The data indicated therein may be subject to periodic changes and updates, also for the purpose of further improving the service for the consumer.

Art. 2 – Prices and product availability

The prices of the products referred to in art. 1 are indicated on the site and are inclusive of VAT. The shipping cost, where foreseen, must be added to the price of the product, the amount of which, always indicated on the site, varies according to the delivery method requested, in addition to any customs duties. In the event that the product is not available, the consumer will be promptly informed by e-mail. The prices and availability of the products marketed by Il Cortile del Castello Soc. Agr. a RL through the website www.cantinedallasta.com are subject to change without notice.

Art. 3 – Purchase contracts entered into by minors

The purchase of products containing alcohol (for example wine) can only be made by people who have completed 18 (eighteen) years of age. The Courtyard of the Castle Soc. Agr. a RL is exempt from any liability in the event of a purchase by a minor under the age of 18 (eighteen), who has provided false information relating to age or false indications to purchase the goods and/or to access the data on the site . In any case, parents are directly responsible for the payment of anything purchased by children under the age of 18 (eighteen), without prejudice to the discipline of withdrawal pursuant to article 6 of these conditions of sale.

Art. 4 – Orders/Invoicing

Orders are accepted through this website. The conclusion of the contract is subject to receipt of the order by Il Cortile del Castello Soc. Agr. to RL. The tax receipt (or the invoice if expressly requested at the time of the order) will be sent together with the delivery of the goods, within the times established by law.

Art. 5 – Delivery of the goods

The delivery of the goods takes place within the terms indicated on the site, to the address indicated by the consumer and by the courier appointed by Il Cortile del Castello Soc. Agr. to RL. In the event that it is expressly provided for, it is possible to collect it directly from the headquarters of Il Cortile del Castello Soc. Agr. a RL located in Via della nave, 14 43013 Casatico di Torrechiara – Langhirano (PR) at the times and methods expressly indicated at the time of the order. It should be noted that, for the purpose of a more efficient delivery of the goods, Il Cortile del Castello Soc. Agr. a RL will communicate to the courier the telephone number provided by the consumer at the time of the order, telephone number, which will be used in compliance with the privacy legislation referred to in European Regulation 679/2016 (GDPR). If the recipient is absent at the time of delivery, the person in charge will leave a message/advice to agree another delivery time with the customer or allow the parcel to be picked up at the nearest courier office. The consumer, upon receipt/collection of the goods, is required to verify the integrity of the same and the correspondence to the order, a check to be carried out in the presence of the person in charge of the delivery. If the packaging of the shipment is damaged, the consumer must ACCEPT the package and note the damage on the waybill/transport document. If the package is intact, the consumer will have to accept it and will be able to sign the delivery receipt also with the wording "ACCEPTED SUBJECT TO INSPECTION". In the event that one or more products are damaged or should not be compliant with the order placed, the consumer, only if he has previously noted the damage on the waybill/transport document or has accepted subject to control, within 3 (three ) working days from the delivery, he will have to inform by email Il Cortile del Castello Soc. Agr. a RL at the address shop@cantinedallasta.com, also providing documentation, including photographs, relating to the damage or incorrect supply, proof of which is the responsibility of the consumer. The Courtyard of the Castle Soc. Agr. a RL reserves the right to request the return shipment of damaged/incorrect goods at the expense of the consumer, shipment which must take place within 15 days of the request from Il Cortile del Castello Soc. Agr. to RL, under penalty of loss of the right to a replacement or refund. The Courtyard of the Castle Soc. Agr. a RL, having verified the existence of the damage or incorrect supply, at its own expense, within and no later than 30 days from the date of delivery or notification, will also replace the damaged/erroneous products or, if this is not possible, to reimburse the consumer for their amount. In the event that the customer contacts Customer Service after the third working day, Il Cortile del Castello Soc. Agr will have the right to a RL decide to open a case for the possible replacement of damaged/incorrect goods.

Article 6 – Right of Withdrawal

The consumer can exercise the right of withdrawal no later than 10 working days from the date of receipt of the goods. This right must be exercised by sending a registered letter with acknowledgment of receipt to the headquarters of Il Cortile del Castello Soc. Agr. a RL, current in Via della nave, 14 43013 Casatico di Torrechiara – Langhirano (PR). The communication can be anticipated, within the same term, also by email to ordini@cantinedallasta.com, provided that it is confirmed by registered letter with acknowledgment of receipt within the following forty-eight (48) hours. The goods must be returned to Il Cortile del Castello Soc. Agr. a RL intact, in unaltered conditions and complete with the original packaging, at the consumer's expense no later than 15 days from the communication of the withdrawal. The Courtyard of the Castle Soc. Agr. a RL will re-credit the sums paid within a maximum of 30 days from the date of receipt of the registered letter and in any case not before having received the goods and checked the condition of the goods subject to withdrawal. The costs and risks associated with returning the products will be borne by the consumer. It should be noted that the Community legislation provides that the right of withdrawal can be exercised only by natural persons (consumers) who act for purposes that can be considered unrelated to their commercial activity. The right of withdrawal, therefore, CANNOT be exercised by legal persons and natural persons acting for purposes related to a commercial activity. Purchases made by resellers or by subjects who in any capacity purchase for resale to third parties are also excluded from the right of withdrawal. The right of withdrawal does not apply to the supply of goods made to measure or clearly personalized or which, by their nature, cannot be returned or are likely to deteriorate or expire rapidly. It should also be noted that, in the case of prize operations (so-called promotions), in which the purchase of an asset is combined with another asset that is sold at a negligible price or given as a gift, the right of withdrawal will be legitimately exercised with the return of both goods purchased, given the constraint of the accessory nature of the good in promotion with respect to the first.

Art. 7 – Limitation of liability

The Courtyard of the Castle Soc. Agr. a RL assumes no responsibility for any damage resulting from the use or incorrect use of the service provided by the website www.cantinedallasta.com. The Courtyard of the Castle Soc. Agr. a RL assumes no responsibility for errors and omissions within www.cantinedallasta.com or any website to which reference or connection may be made. The Courtyard of the Castle Soc. Agr. a RL reserves the right to continuously update the website www.cantinedallasta.com which can be done at any time. The information may contain inaccuracies of any kind or typing errors. The Courtyard of the Castle Soc. Agr. a RL does not guarantee that the services performed by www.cantinedallasta.com will be provided without interruptions, this will be announced in advance except for causes beyond the control of Il Cortile del Castello Soc. Agr. a RL The Courtyard of the Castle Soc. Agr. a RL disclaims any liability to the purchaser or any third party for direct or indirect damages (including, without limitation, loss of profits, revenues, business opportunities) arising out of or in connection with a product or service provided from Il Cortile del Castello Soc. Agr. a RL, or from the use or inability to use the same. The Courtyard of the Castle Soc. Agr. a RL assumes no responsibility for disservices attributable to unforeseeable circumstances or force majeure, such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events which may prevent, in whole or in part, the execution within the times agreed in the contract. The Courtyard of the Castle Soc. Agr. a RL will not be liable for damages, losses and costs incurred as a result of the non-execution of the contract for the above-mentioned causes, possibly having the consumer only entitled to a refund of the price paid. Without prejudice to cases of willful misconduct or gross negligence, the right to compensation from Il Cortile del Castello Soc. Agr. a RL cannot be higher than the price of the products purchased by the consumer and for which the dispute has arisen.

Art. 8 – Responsibility of the user/consumer

The user is required to ensure that the data entered is true, complete, updated and to promptly communicate any changes to the same. In the event that false declarations are made, Il Cortile del Castello Soc. Agr. a RL reserves the right to exclude such subjects from its user lists, after a formal and unaccepted invitation for self-correction.
